In the Diamanti case I don't see how Brescia Calcio could argue their case for not paying West Ham...can we now please have our money ?

Not true. We were withholding most of the fee from the Danish club because FIFA wouldnt interfere with the fact Brescia refuse to pay us despite having the cash to do so

From the winky smiley face thingy, I think it's safe to assume Cuenca was joking :thup:

But I guess that raises another question - why are we allowed to continue to buy and sell players when we are withholding transfer fees from third parties?

Surely there should be some sort of transfer embargo on us, Brescia, FC Midtjylland (plus whoever else) until the situation is resolved?

We chastise the Italian FA for not doing anything about this, yet our own FA should also be involved to support a member team, yes the same FA that paid us didly squat for Ashtons career ending injury whislt on international duty

How could even we as West Ham possibly lose this case ? You sign a player under contract from another club you obviously pay the agreed transfer fee, in one lumpsum or in installments. Brescia haven't paid up yet and apparently refuse to do so.
If this behaviour is deemed alright by the courts this will obviously change the way transfers will be organised in the future.

Selling clubs will demand the entire transfer fee to show on their bank accounts before releasing the player. Clubs will be reluctant to accept payment in installments as is common practice nowadays. Brescia don't have a leg to stand on here and West Ham shouldn't suffer from it. They may have to sell some of their players to generate the two million we are due but we as a club cannot allow to be pushed around anymore. Especially now that we are a Premier League club again we should fight our corner.

I wouldn't expect much sympathy from the media though - it's only West Ham after all...

If we lose the case will be dismissed - that'll be the end of it. I don't see what choice we have but to sue them.

And that's the problem, we lose this will not just affect West Ham, this will affect the way that all transfers are concluded from now on! This is pure & simple as a case should be, they have stolen what was our property & are refusing to pay for it! Worse then that with the deal they have struck with Bologna they are rubbing our noses in it!

The thing is god only knows how the court will rule?

How and on what foundation could a court actually rule in favour of Brescia here, even if the court was in Italy ?
People would start signing players from Italy in return and not pay for them...

I would like to hope there is no way this would happen! But I find it strange that neither the FA or the Italian FA for that matter have got involved or that UEFA haven't forced the issue either!

How another team can sell a player they haven't even payed for should surely be illegal as well?

They wouldn't if they were to be taken to court in their own country, as a UK court would find against the club that failed to pay in the event that the claim was legitimate.

I'm not a legal expert but you may well find that stuff like this goes to arbitration in somewhere neutral or whatever.

I think many fans saw that spark of unpredictability and passion that we all saw in Di Canio - a classic "what might have been". He could well have been a huge player for us. What frustrates so many of us is that he never got the chance to shine in his favoured position. A player with such potential wasted. His left foot is devastating - no one can deny that.
