Judicial review. It all sounds rather fishy to me, and I wish I could share TPP's confidence that the government will hold firm on
their insistence that there must be a track at the O/S: If there is tumbleweed blowing across the stadium for 95% of the year it
will be labeled a White Elephant and they will get the flak.

Does anyone know the details of the proposed Newham/WHU deal and on what grounds the judge has decided that it
constitutes "State Aid" ?
The deal is Newham will borrow up to £40 million which it will then loan to the Stadium management company jointly owned by WH and the council. He hasn't, the judge has merely decided that spurs and Orient have the right to make that case at a judicial review.

The Guardian, Friday 19 August 2011

London will bid for the 2017 World Athletics Championships after the government promised its full support, despite earlier concerns that Tottenham Hotspur's ongoing high court challenge could derail it.

The bid for the championships, seen as key to providing a legacy for athletics from the 2012 Olympic Games and justifying the decision to award the stadium to West Ham over Spurs and retain the track, was shrouded in uncertainty given the ongoing legal challenge.

But it is understood that, having sought legal advice, the sports minister, Hugh Robertson, and the mayor of London, Boris Johnson, vowed to provide the necessary guarantees regardless.

It is believed they were advised that even if a bid by Spurs to seek a judicial review of the contentious decision to award the stadium to West Ham was successful, they could retender on the basis that the track must be retained.
Spurs argued that retaining the athletics track was unviable and proposed instead to rebuild a dedicated football stadium.
If this is true Spurs can't possibly win in the end apart from getting the regeneration funding for WHL.

I think we should tell them to shove their ground and leave the government to play with their second massive white elephant in London. Good luck filling it (except for one night during the 2017 World Athletics of course).

West Ham United statement

A West Ham United statement said: "We acknowledge that the final hurdle of a Judicial Review against London of Borough of Newham and the OPLC in relation to West Ham United being the preferred bidder for the Olympic Stadium has been granted on a very narrow basis.

"A full hearing will take place on 18 October and we remain confident that Newham and the OPLC will be successful in defending limited points regarding the £40m loan that would be made to the Legacy Stadium Partnership.

"Separately, and only for clarification as we have been inundated with inquiries with regard to a Scotland Yard statement today, we confirm the Metropolitan Police's Economic and Specialist Crimes Unit is dealing with the serious matter of a private investigator acting unlawfully, reportedly under instruction by Tottenham Hotspur.

"This is in relation to reported breaches of the Data Protection Act and Computer Misuse Act as a result of the unlawful acquisition of bank and telephone records belonging to senior executives at the club and the OPLC.

"We are advised that if found guilty of these crimes, those responsible can expect to receive custodial sentences. We have full faith in the police investigation into this matter and shall continue to provide the fullest of assistance to them.

"In response to media inquiries, we can confirm that West Ham today received a document from Tottenham asking us to give up our claims against them in relation to the above, in return for Tottenham withdrawing their judicial review proceedings. West Ham naturally refused.

"We look forward to the 18 October and a successful conclusion whereby we can deliver the multi-sport legacy that Lord Coe envisaged for east London and the rest of the nation."

Spurs offered to withdraw the review bid if we backed off doing them over the dodgy detective. Someone over WHL must be ****ting bricks. Why aren't Sky etc reporting this bit I wonder.

Now it has been shown that Spurs don't want Stratford, if we did tell the government to shove it, then within a few years they will come knocking on our door begging us to take it off their hands and turn it onto a football stadium!

if this is true we should let the police deal with them and if true i cant believe how stupid they are. they are more or less trying to brush under the carpet illegal stuff they have done then expect us to scratch their back. we should never deal in anyway with these scumbags again. if our board sell parker to them it will show money is king and they have no balls. i would rather give parker to milljank for free than deal with tottscum ever again in any form.

Some use of selective quotes here, what Spurs actually 'offered' was during discussion with the mayor's office prior to the judgement today a deal was discussed. The mayor's office wanted Spurs to withdraw all proceedings, Spurs wanted confirmation that 'riot' funds would be used for infrastructure, that they would receive RGF approval and that any pending court action surrounding the bid would be terminated.

It looks like West Ham refused to drop proceedings, Spurs went ahead and won the right to request a judicial review. This puts the Athletics World Championships in doubt although they are confident the have a 'fix' for the September bid, should Spurs have the Newham loan declared illegal then the whole OC is back to square one ..... albeit the OLPC can make the running track a pre-requisite and thus block Spurs bid that way ..........

Just a note - The Met Police are not at this stage investigating Tottenham or any of it's direct employees, the investigation relates to two individuals accused of unlawful acquisition of bank and telephone records. This could lead back to Tottenham but putting the whole OS process at risk over this? what are we thinking?

Not sure how we've gained anything by our actions ..... we will see

I don't know what we are thinking, but I hope it's along the lines of "how ****ing dare they stalk our employees using dodgy (at best) means. How ****ing dare they try to slander us over the way we conduct our business whilst carrying on this way. How ****ing dare the club that have bleated on for nearly a century about Arsenal moving into their area suddenly think it's ok to move into ours. How ****ing dare they use the roits in Tottenham as a stupid PR stunt to muscle money from the government. How ****ing dare they?"

I hope we see this through, no matter what the cost to us. Spurs have acted appallingly towards us (and the taxpayer) over the whole affair from slagging off our bid to hiring private detecites to muckrake our employees. Whoever authorised it deserves some time at her majestys expense.

That is shocking...and not at all suprising. They really are scum. Trying to hide their criminal activities so we can have the OS.

I hope people at spurs goes to prison for this, because any of us would if we had done he same. And i hope G&S never back down

Why is this paragraph not in the news yet? if that was west ham it would be plastered everywhere and everyone would be slagging us off and hating us...more than usual.

I suspect that the only time that this will ever get any column inches in the press is when / If anybody actually recieves a custodial sentence for it.

I'm afraid that until then, the press will be scared shitless to print anything that points the finger of blame at anyone that may be involved in phone hacking. The press knows full well that it will undoubtedly come back to bite them in the arse at some point.

Add that to the fact that Spurs seem to have the sun shining out of there aresholes over the last 2-3 seasons in the eyes of the media, although I have noticed that this opinion in the press is starting to turn due the childish way in which Levy is acting over the Modric saga.

Precisely why I believe the owners should reverse their decision .

Play the long game .Wait until UK Athletics is bleeding cash , and then take the site , get rid of the track - make the stadium suitable for football , and build them a grandstand on the warm up track for the athletics .

I have thought all along that this is what they are going to do.
The "Legacy" of a running track at the site of the Olympic Stadium, doesn't necessarily mean within the Olympic Stadium.

This would be the right long term decision, but I doubt the board would have the guts to pull out now!

Judicial Review over Tottenham’s Stadium Redevelopment Plans

Post by Wembley1966 »

Their turn to face a judicial review today!!

Judicial Review over Tottenham’s Stadium Redevelopment Plans

Today the offshore game will be reporting from the judicial review into the compulsory purchase of land for the redevelopment of Tottenham’s stadium. Tax justice lies at the heart of this case and this is why we are interested.

    Tottenham’s offshore owners

Tottenham are big players in the offshore game. The club is owned by ENIC International, a private company located in the Bahamas, where their tax exile owner Joe Lewis lives.

Joe made his money currency trading and was notably one of the men who bet against the pound on Black Wednesday, forcing it out of the European Exchange Rate Mechanism.

Joe is reportedly worth $4.8bn, if you believe such statistics, and has a collection of art rumoured to be worth over $1bn.

    Public sector support for stadium

However, it seems that Tottenham need some financial help from the public in order to complete their stadium plans.

The club believe the current White Hart Lane is not fit for a club seeking to compete with the top clubs in Europe. As explained by one football consultant, every match day the club falls £1m behind rivals Arsenal.

They have plans for a wholesale redevelopment of the site and indeed other peoples’ land too. The proposed redevelopment will include new luxury housing and a supermarket and will demolish part of a housing estate to create a new walkway to the stadium.

The plans also require the compulsory purchase of land to go forward.

    Public obligations

Such a large scale redesign of an area puts a heavy burden on the developer. Planning policy says they should provide affordable housing with their new development, as well as a contribution to the local infrastructure they require to move the scheme forward.

But Tottenham claimed they couldn’t pay for it. They told their local council that unless they were allowed to build no affordable housing, and the public pay for the local infrastructure around the stadium, they would go and play somewhere else. They started contemplating a move to the Olympic Stadium in Stratford.

Well considering this all goes back to 2008 trying to get permission for all this it already has gone pretty tits up in many ways. Must have cost them a fortune one way and another. Remember as part of the World Cup proposal they promised to have been playing for at least 2 seasons in that stadium. At present it remains vapourware.
