Why have they been given the right to press ahead? Well obviously they have dirt on us the thing is if they can get it out in the open without being charged for breach of Data Protection is another thing!

Conversely if a partner in such a bid is a local authority then it is absolutely 100% certain that public money must be involved....
Surely the ruling can't be that local authorities cannot enter into such partnership bids in their own borough without judicial review purely on the basis of that ????????
There must be something questionable about the procedure through which Newham obtained and handled the money is the only thing I can think of that makes sense.
More apposite than beak grants judicial review on the basis of public money is beak doesn't grant judicial review on the basis of anything else, beaks decision rules a lot of things out.

Limited knowledge but state aid is normally about ensuring that an entity hasn't achieved a competitive/commercial advantage purely as a result of funds provided by the state.

This seems like de ja vouz, like Sheff Utd. Keep on going to court until they get the answer they want. f*** 'em, let them have the stadium, let them move to Stratford, and watch them go skint because they have spent £££££'s redeveloping the site, and end up struggling to even qualify for Europa League.
Even so, I cannot see how it can ever be seen as 'State Aid', as it is a commercial partnership with a unitary local authority. But what do I know?

For clarification: The review can only look at the decision making process, not the decsision itself.
Spurs will not be able to argue for the decision to be overturned.
The best they can hope for is that the review finds in their favour, that the decision was unfair, and the bid books have to be opened all over again.

I'm looking at this in a very different light, Judicial review granted to Spuds a day after they have been given encouragement about a site of their own, surely the ball is totally in their court and gets the govt out of a sticky situation?

This has totally blown me away. One minute they are in agreement with Boris and all is rosy. Next thing Boris offers them a pittance so Levy spits his dummy out and goes to court regardless. This is nothing short of Blackmail ! Had Boris given them £50m Govt money yesterday, none of this would have happened.

why don't we just arrange a meeting with boris and say 'look. can we have millions of pounds to build a new stadium near where we are now? if we can then let spurs have the olympic stadium. if we can't then we are gonna drag this olympic stadium bidding process through every court in this land (and those of europe if need be) until you do give us enough money to build a new stadium near where we are now'

It is blackmail Ozza - the Govt have now committed to 2017. If thfc press on with this bowlocks, the chances are that the Govt could be embarrassed. The Govt will cave in and give them what they want - STATE AID - precisely the thing that they are up in arms about. Spurs have the government, West ham, OPLC, and Boris over a Barrel.
Very clever by Levy.
The outcome is pretty obvious IMO they will get what they want out of this an easier path with regards to funding, transport links, and planning permission for their new football stadium in T*ttenham. They will probably get a karge chunk of money to stop this process getting any further as the deadline for the world athletics championship in 2017 is next month and JR will take place in October.
It will all be sorted before then.
Sp*rs will get their shiny new football stadium for less of a cost than first thought and we will be left with souless bowel that is the OS with our binoculas!

Without sounding like your clone pinky, but I said in my very first post on the Olypic stadium thread how spurs seem to scupper there chances of winning the bid at every opportunity, and it has now become apparent that they were coersed into bidding by Boris who advised spurs that a bid to convert to a football stadium would be seriously considered. I think most people now realise that this was never the case, based on us winning hands down and spurs winning no votes at all. They were never in the race.the pink palermo wrote:

levy has no intention of moving to stratford, he just wants to nail the os down to keeping the track for 50 years and if not installing a 200 mill compensation payment to the spuds. this is how much more a stadium in tottenham will cost as to if the had got the os.
obviously he wants leverage with boris/government for an enterprise zone, but as much as we may hate and abuse him to many fools took liberties with one of the most litigious chairmen in the sport. he knows he has newham and boris by the knackers.
just to add whatever happens levy cannot force the oplc to reopen the bidding proccess but almost definitely newham will have to withdraw the offer of the 40 mill loan.
